WAIVER OF LIABILITY AND RELEASE AGREEMENT
This Waiver of Liability and Release Agreement (“Agreement”) is executed by the undersigned participant, whether a volunteer or paid staff member (“Participant”), in favor of Re Life, Inc. or Hill City Church, Inc., its officers, employees, contractors, agents, and affiliated entities (collectively, “Organization”), in the housing initiative program.
1. Acknowledgment of Risks
I acknowledge and understand that participating in the Re-Initiative program, which involves home renovation activities (e.g., tear outs, remodels, painting, yard work, cleaning), poses risks including but not limited to:
Physical injury from tools, ladders, heavy lifting, and accidents.
Exposure to hazardous materials such as asbestos, mold, or lead-based paint.
Electrical, plumbing, or structural hazards in homes under renovation.
Health risks (e.g., COVID-19 or other contagious diseases).
I understand these risks and certify that I am physically capable of participating in these activities.
2. Voluntary Participation and Assumption of Risk
I voluntarily participate in the housing initiative program, fully assuming all risks, including injury, illness, death, or property damage, whether caused by the negligence of Re Life or Hill City Church or otherwise.
3. Waiver and Release of Liability
In consideration of being permitted to participate in the housing initiative, I, on behalf of myself, my heirs, and assigns, hereby release and hold harmless Re Life and Hill City Church, its officers, employees, contractors, and agents from any and all claims, damages, or liabilities arising from my participation in the program, including those caused by the Organization’s negligence.
4. Safety Compliance
I agree to follow all safety instructions, rules, and guidelines provided by Re Life or Hill City Church or its project supervisors. I understand that failure to comply with these instructions may result in my removal from the project, and the Organizations will not be liable for injuries resulting from non-compliance.
5. Tools and Equipment Responsibility
I acknowledge that I am responsible for the safe use of tools and equipment, whether provided by the Organization or brought by me. I agree to indemnify the Organization for any damages or injuries caused by my improper use of tools or equipment.
6. Medical Treatment Authorization
I authorize Re Life or Hill City Church to seek necessary medical treatment on my behalf in the event of injury or illness. I understand I am responsible for the costs of any such treatment.
7. Insurance Coverage
I acknowledge that Re Life or Hill City Church does not provide accident, health, or liability insurance for volunteers or independent contractors. I am solely responsible for any insurance coverage needed for my participation.
8. Independent Contractor Status (For 1099 Workers)
I acknowledge that if I am working as an independent contractor (1099 worker), I am not an employee of Re Life or Hill City Church and I am responsible for my own liability insurance and workers' compensation, if applicable. I expressly waive any right to claim workers' compensation benefits from the Church.
9. Dispute Resolution
Any disputes arising out of this Agreement or the housing initiative program will be resolved exclusively in the Circuit Court of Floyd County, Indiana, under Indiana law.
10. Photo/Video Release
I grant Re Life and Hill City Church permission to use photographs or videos taken of me during the housing initiative program for promotional purposes, without compensation.
11. Parental Consent (If Applicable)
If the participant is under 18, the parent or guardian must sign below, indicating their consent for the minor to participate and assume all risks.
12. Entire Agreement
This Agreement constitutes the entire understanding between Re Life or Hill City Church and the Participant regarding the housing initiative program and supersedes any prior agreements.
